TERMS AND CONDITIONS

These Terms and Conditions ("Terms") form a binding legal agreement between you ("you", "your", or the "User") and Rovion Games ("we", "us", "our", or the "Company") governing your access to and use of our mobile game Samosa Rush (the "Game") and any related services we provide.

BY DOWNLOADING, INSTALLING, OR USING THE GAME, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT DOWNLOAD, INSTALL, OR USE THE GAME.

1. Eligibility

You may use the Game only if you meet all of the following conditions.

You are at least 13 years old, or the minimum age of digital consent in your jurisdiction. If you are under that age, you may use the Game only with the verifiable consent and supervision of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

You have the legal capacity to enter into a binding agreement.

You are not barred from using the Game under the laws of your jurisdiction or any prior action by us.

You are not currently suspended or banned from the Game or any related service.

By agreeing to these Terms, you represent and warrant that you meet these conditions.

2. License to Use the Game

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the Game on a mobile device that you own or control, solely for your personal, non-commercial entertainment.

We retain all rights, title, and interest in and to the Game and all related intellectual property, including game code, art, music, characters, names, story, mechanics, and trademarks. No rights are granted to you other than those expressly stated in these Terms.

3. Prohibited Conduct

You agree that you will not do any of the following.

Cheat, exploit, or modify the Game, including using bots, automation tools, macros, third-party clients, modded APKs, memory editors, or any software that interacts with the Game in a way not intended by us.

Reverse engineer, decompile, or disassemble the Game or any part of it, except to the limited extent applicable law expressly permits.

Abuse bugs, glitches, or exploits to gain in-game advantages, currency, or progression that would not otherwise be available to you. You agree to report bugs to us rather than exploit them.

Tamper with save data, network traffic, or in-app purchases, including using rooted or jailbroken devices to bypass purchase verification or grant yourself in-game items.

Use the Game for commercial purposes, including selling accounts, in-game items, or in-game currency for real money or anything of value.

Impersonate another person or misrepresent your affiliation with any person or entity.

Harass, threaten, or harm other players through any communication channel related to the Game.

Upload, transmit, or display any content that is unlawful, infringing, defamatory, obscene, or otherwise objectionable.

Use the Game in violation of any applicable law, including export controls, sanctions, anti-money-laundering laws, and child-protection laws.

Interfere with or disrupt the Game, our servers, or our third-party service providers, including denial-of-service attacks, excessive automated requests, or attempts to gain unauthorized access.

Circumvent any age-gate, consent flow, or regional restriction built into the Game.

Chargeback or reverse legitimate in-app purchases in bad faith.

Sell, trade, or transfer your in-game progress or account to any third party.

Violation of any of the above is a material breach of these Terms.

4. Account Suspension and Termination

We reserve the right to suspend, restrict, or permanently terminate your access to the Game, including deleting your save data, in-game currency, in-game items, and in-app purchases, for any of the following reasons.

Violation of these Terms, including any prohibited conduct listed in Section 3.

Cheating, exploiting, modding, botting, or otherwise using third-party tools to gain unfair advantages.

Abuse of bugs, glitches, or exploits that you knew or should have known were not intended behavior.

Fraudulent or unauthorized in-app purchases, chargebacks made in bad faith, or violations of the payment provider's terms.

Use of stolen, fraudulent, or compromised payment methods.

Account sharing, selling, trading, or transferring in violation of Section 3.

Harassment, abuse, hate speech, or threats directed at us, our team, or other players.

Activity that we reasonably believe poses a security, financial, or legal risk to us, other players, or our service providers.

Compliance with law, court order, or lawful request from a competent authority.

Repeat or egregious offenses, even after a prior warning or temporary suspension.

Inactivity, meaning extended periods of non-use, in accordance with our published account-retention policies where applicable.

Where appropriate and reasonable in the circumstances, we may issue a warning or temporary suspension before permanent termination. For severe violations such as cheating, fraud, or attempted unauthorized access, we may terminate your access immediately and without prior notice.

You acknowledge that suspension or termination may result in the loss of your in-game progress, virtual currency, virtual items, and in-app purchases, and that you will not be entitled to any refund or compensation for such loss, except as required by applicable consumer-protection law or the policies of the relevant app store.

If you believe your account was suspended or terminated in error, you may contact us at support@roviongames.com with the subject line "Account Appeal" and provide reasonable details. We will review appeals in good faith but make no guarantee of reinstatement.

5. Virtual Currency, Virtual Items, and In-App Purchases

The Game may offer virtual currency such as coins or gems, and virtual items, that can be earned through gameplay or purchased through your device's app store, such as Google Play Billing or Apple App Store.

Virtual currency and virtual items have no real-world monetary value. They are not refundable, transferable, or exchangeable for real money, real goods, or any other item of real-world value, except as we may expressly permit.

All purchases are final. Refunds, where available, are governed by the policies of the relevant app store (Google Play or Apple) and by applicable consumer-protection law. We are not obligated to provide refunds beyond those required.

We may add, remove, modify, re-price, retire, or revoke any virtual currency or virtual item at any time, including in response to inflation, balance issues, fraud, or discontinuation of the Game.

You do not own virtual currency or virtual items. You receive only a limited, personal, revocable license to use them within the Game while your account is active and the Game is operational.

If your account is suspended or terminated under Section 4, you forfeit any unused virtual currency and virtual items.

You are responsible for any taxes, fees, or charges associated with your in-app purchases.

6. Updates, Changes, and Service Availability

We may, at any time and for any reason, do the following.

Update the Game, including bug fixes, security patches, new features, balance changes, and removal of features. Some updates may be mandatory in order to continue using the Game.

Change game mechanics, economy, or content, including in ways that affect progression difficulty, virtual currency value, or item utility.

Suspend or discontinue the Game, in whole or in part, including shutting down servers, removing the Game from app stores, or ending support for older device versions.

We do not guarantee that the Game will be available at all times, that it will be free of bugs or errors, or that any specific feature will be retained. We will use commercially reasonable efforts to provide stable service but make no warranty of uninterrupted availability.

If we decide to permanently discontinue the Game, we will provide reasonable advance notice where practicable, but we are not obligated to refund any unused virtual currency or in-app purchases beyond what applicable law and app-store policies require.

7. Third-Party Services

The Game integrates with third-party services, including Google Firebase (Analytics, Crashlytics, Remote Config), Google AdMob and its mediation partners for advertising, Google Play Services and Google Play Billing or the Apple equivalents on iOS, Google User Messaging Platform (UMP) for consent, and Google Play Games Services (including the Saved Games API for cloud save functionality).

By signing in to Google Play Games, you also agree to Google's Play Games Services Terms of Service. If Google Play Games is unavailable on your device or you choose not to sign in, the Game will function with local save only and cloud save features will not be available to you.

Your use of these services is also governed by their respective terms and privacy policies. We are not responsible for the acts or omissions of these third parties, the availability of their services, or any harm arising from their handling of your data beyond what we expressly accept under our Privacy Policy.

8. Advertising

The Game is supported by advertising. By using the Game, you agree to the following.

We may display banner ads, interstitial ads, and rewarded ads within the Game.

Ads may be personalized based on your consent and applicable law.

We are not responsible for the content of third-party ads, the products or services advertised, or any transaction you enter into with an advertiser.

You may choose to disable personalized advertising through the in-game consent settings or your device's ad-tracking settings. This does not eliminate ads, but causes them to be non-personalized.

9. Disclaimers and No Warranty

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. To the maximum extent permitted by applicable law, we disclaim all warranties, express, implied, or statutory, including but not limited to the following.

Implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Warranties that the Game will be uninterrupted, error-free, secure, or virus-free.

Warranties that any defects will be corrected.

Warranties regarding the accuracy, reliability, or completeness of any information provided through the Game.

Warranties that third-party ads or content displayed in the Game are accurate, safe, or non-infringing.

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the above exclusions apply only to the maximum extent permitted by law, and any non-excludable warranties are limited in duration to the minimum period allowed by law.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, in no event shall Rovion Games, its officers, directors, employees, contractors, agents, affiliates, or licensors be liable for any of the following.

Any indirect, incidental, special, consequential, exemplary, or punitive damages.

Loss of profits, revenue, goodwill, data, or virtual items.

Damages arising from your inability to use the Game, from any bug, glitch, server outage, or service interruption.

Damages arising from any third-party content, ad, or service displayed in the Game.

Damages arising from suspension or termination of your account under these Terms.

Damages arising from your reliance on any information obtained through the Game.

To the extent any liability cannot be excluded under applicable law, our total aggregate liability to you for all claims arising out of or relating to the Game shall not exceed the greater of (a) the total amount you have paid to us through in-app purchases in the twelve months preceding the event giving rise to liability, or (b) one hundred Indian Rupees (INR 100) or one United States Dollar (USD 1.00), whichever is higher.

Some jurisdictions do not allow certain liability limitations. In those jurisdictions, the above limitations apply only to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Rovion Games, its officers, directors, employees, contractors, agents, affiliates, and licensors from and against any claims, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to any of the following.

Your use or misuse of the Game.

Your violation of these Terms.

Your violation of any law or the rights of any third party.

Any content you submit, post, or transmit through the Game.

Any in-app purchase dispute or chargeback you initiate.

12. Changes to These Terms

We may modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of these Terms. We will provide reasonable notice through the Game, on our website, or by other reasonable means. For changes that materially reduce your rights, we will use commercially reasonable efforts to notify you in advance.

Your continued use of the Game after changes take effect constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Game and uninstall it. Continued use is your acknowledgment that you have reviewed and accepted the updated Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-laws rules.

Any dispute arising out of or relating to these Terms or the Game shall be subject to the exclusive jurisdiction of the courts located in Kolkata, West Bengal, India, except where applicable consumer-protection law gives you the right to bring claims in your local courts.

Before commencing any formal dispute, you agree to first contact us at support@roviongames.com with the subject line "Dispute Notice" and a description of the issue, and to give us at least thirty (30) days to attempt to resolve the dispute in good faith.

14. No Class Actions, Individual Claims Only (Where Permitted by Law)

Where permitted by applicable law, you and we each agree that disputes will be resolved only on an individual basis, and not as a class, consolidated, or representative action. Neither party will participate in a class action against the other. This section does not apply where prohibited by mandatory law, including certain Indian consumer-protection statutes.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or, if it cannot be so modified, it shall be severed and the remaining provisions shall continue in full force and effect.

16. No Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or any other provision. No waiver shall be effective unless in writing and signed by an authorized representative of Rovion Games.

17. Assignment

You may not assign or transfer these Terms, in whole or in part, without our prior written consent. We may assign these Terms at any time, including in connection with a merger, acquisition, financing, or sale of all or part of our business.

18. Force Majeure

We shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, pandemics, government action, internet or telecommunications failures, third-party service outages (including Google Play, Firebase, or AdMob), labor disputes, or any other event of force majeure.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rovion Games regarding the Game and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us regarding the Game.

By using Samosa Rush, you acknowledge that you have read, understood, and agreed to these Terms and our Privacy Policy.
